2. Scope and conditions of use
The App is optimised for all iPhone devices from SE and all Android devices from version 6. Use of the App requires an Apple iTunes Store or Play Store account. Apple and Google have their own Privacy Policies, for which Foodways is not responsible. For more information, please visit their respective websites.
Users who possess a Waste Tracker account are able to choose from two possible subscriptions:
Basic: A free subscription. You can measure your food waste three times a year for up to 14 days. You also have access to two charts that give you insight into your current levels of food waste.
Premium: A paid subscription. You can measure for up to 30 days, 10 times a year. You also have access to two more detailed charts, savings forecasts and suggested measures, through an interface with the Food Save app.
The premium version of the App is only available as a 12-month subscription, with the exception of the free trials offer as part of our coaching packages, as mentioned below.
Foodways also provides coaching for food service companies. During the coaching period, companies are able to benefit from a free upgrade to the Premium subscription. Once the coaching is completed, the user’s account will automatically be downgraded to a basic account. The user can continue to benefit from the premium features by purchasing a 12-month subscription in the Premium section of the profile tab.
3. Payment and cancellation
If you live in a country that is part of the European Union and you purchased a paid subscription through the App, you have the right to claim a full refund of the purchase price within 14 days from the date of purchase. This is only valid if you have not logged in since the purchase and have not yet entered a new premium measurement.
In the case of paid subscriptions, the payment obligation to Foodways is automatically renewed at the end of the respective subscription period, unless the user cancels the subscription at least one day in advance of the renewal date. This can be done under the Premium section of the profile tab in the App.
Users will be contacted by e-mail one month in advance of the end of the subscription period to inform them on which date the automatic payment will be taken. If you cancel your subscription before this date, the cancellation will take effect the day after the last day of your ongoing subscription and you will be downgraded accordingly to the basis version of the App.
However, if you cancel your subscription after the 14-day period and before the end of the relevant subscription period, no pro rata refunds will be issued for the remaining period of the subscription.
Foodways reserves the right to change the prices for paid subscriptions and will inform users of any price changes accordingly. Price changes for paid subscriptions will take effect at the beginning of the next subscription period following the date of the price change. By continuing to actively use the Waste Tracker App after the price change has taken effect, the new prices are deemed agreed.
4. Foodways services
The App is generally available 24 hours a day, 7 days a week. Foodways reserves the right to limit and/or temporarily suspend these operating hours for technical reasons or to modify the App.
Foodways makes reasonable efforts to keep the Waste Tracker App in good working order. However, certain technical difficulties or maintenance may occasionally cause temporary disruption. Foodways will bear no liability for any disruption caused by technical difficulties or App maintenance.
Foodways reserves the right to modify and suspend any app features at any time, both temporarily and permanently, including without notice and without any liability to you for such interruptions or changes. Foodways has no obligation to maintain or further develop the service.
Subject to mandatory legal provisions, Foodways accepts no liability for direct or indirect damage caused by the use of the App. We take great care when creating our tools, but there is no guarantee that all content is accurate, complete and up to date. The use of information and data obtained from the App must be compliant with Foodways’ ownership and copyright.
6. Copyright and other intangible assets
Foodways and its licensors reserves all copyrights and other proprietary rights to the App, including layout, software and content. In particular, publishing, modifying, offering, selling, duplicating, distributing, sending, renting and licensing the editorial and other content of the Waste Tracker app (texts, pictures, graphics) is only permitted with the explicit written consent of Foodways.
Furthermore, the production, transfer and/or sale of second-hand works is not permitted. It is forbidden to display the product in whole or in part using technical aids (e.g. "framing").
